Terms and conditions of use
(«the Terms» («the Agreement»))

The Terms as put fourth in this Agreement is between DrivstoffAppen AS (org. no. 923 379 347) (“we”, “us” etc.) and you as the user or subscriber (“you”, “the user” etc.) of the FuelApp/ BränsleAppen/BrændstofAppen/PolttoaineSovellus (the “Service”, the “App” and “FuelApp”). The App is developed by DrivstoffAppen AS and is a Service designed to make it easy for you to find the lowest fuel prices.
To use of the App, you must accept these Terms when you first download and install the App. By accepting this Agreement, you are herby obligated to follow our rules and guidelines as put forward in these Terms. If you do not wish to be bound to these Terms, you must delete your account and stop using the Service immediately.
1 Access to the Service, registration of your user account and subscription
You must be 18 years of age to use the Service.
Your access to the App is personal and shall only be used by you. If you grant others access to your account, you will be legally and financially liable for ensuring that the use is in accordance with these Terms.
The App can be downloaded at the App Store or Google Play. Creating a user is free and will give you access to a variety of features of the App. It is also possible to purchase a subscription to access additional features. You can read more about the different subscriptions in the App and under section 4.
The App is developed and made available to make your everyday life easier by providing a Service that makes it possible for you to locate the lowest fuel price accessible. In order for us to be able to provide this Service, you must commit to only use the App in accordance with its purpose and features. This means that by using the Service you confirm that you will:
A. use the service in accordance with applicable law
B. provide correct, accurate and true information when creating/modifying your profile account
C. act in accordance with the purpose of the Service, which is to facilitate the users of the App to find the cheapest fuel price
D. update correct fuel prices
E. only confirm prices that are correct
F. not attempt to gain unauthorized access to the App or parts of the App
G. respect the rights to the App that DrivstoffAppen AS holds, such as but not limited to the intellectual property rights
H. not attempt to gain access to the source code or the software components of the App
I. not attempt to extract or collect information form the App, such as but not limited to fuel prices or/and other users’ information or data
J. not use the App or any of the content of the App for any commercial purpose without obtaining our prior written consent
3 Violation of the Terms and the Agreement
If a breach of the Terms is discovered and there is a violation of the Agreement, your account may be terminated and your authorization to use the Service will be revoked. If we have a suspicion that a breach has occurred, you will get a notice before the account is taken down. This will provide you with an opportunity to get in contact with us to request the grounds of the decision and put forward a complaint.
If you are a subscriber and you have violated the Terms and you have been banned from the Service, you will not be entitled a refund for the purchase.
4 Purchase of subscription services
There are three types of subscriptions the Service offers: bronze, silver, and gold subscriptions. The purchase of the various subscriptions will be enabled through the App Store or Google Play depending on what device you have. We will receive a purchase confirmation once the transaction is completed by the selected payment provider. The subscription will be automatically renewed at the price you agreed to when you subscribed.
The subscription will be active until you choose to cancel it in App Store or Google Play, depending on what device you have. This applies even if you have deleted your account in the App or deleted the App from your device.
You have the right to regret your purchase in accordance with local law and cancel your subscription within 14 days after the purchase was made.
If the purchase was made through the App Store, the refund will be managed by Apple. To request a refund, log into your account, select “Purchased”, find the App, and select “Report a Problem” and then select I would like to “Request a refund”.
If the purchase was made using your Google Play Store account, please contact us by e-mail with your order number (that you can find in the confirmation e-mail you received when the transaction was made, or by logging into your account). Please provide the text “refund” in the subject field of the e-mail.
You will find information about what functions you have access to in the App under the description of the different subscriptions.
7 User Responsibility
We will implement security measures that ensures that your information is protected against unauthorized access and use. You will also be able to protect your account against unauthorized use through sufficient password protection. It is important that you do not under any circumstances share your private password or login details with others. We will assume that all activity that may be associated with your user has been carried out by you. If you suspect that others have access to your account, you must contact us immediately by using the contact information that you can find in section 12.
The App is provided “as is”. We make no warranties of any kind, and we cannot guarantee that the Service will be uninterrupted, secure, or free of errors. The App may be unavailable at times for several reasons, for instance due to maintenance. We can also choose to discontinue the App. We will not be liable for any direct or indirect damages or loss as a result of the Service being inaccessible, unless this is determined by court.
Although we work hard to offer you as a user the best experience, we cannot guarantee that the location at stations and prices is correct. This is due to that information is provided by users or third-party services, so we cannot be liable for that the given information is accurate.

8 Change of Terms
We work continuously to improve and develop the App. This may have an impact on the Terms and changes may occur. We will notify you in reasonable time if we implement changes that will affect your use of the App. However, small changes may be implemented without notice.
9 Changes to the Service
We want to provide you with the best Service possible and will therefore make changes to improve the App from time to time. We therefore reserve the right to make changes to the App and switch technical providers. This may require that you as a user must update the operating system on your device to be able to access the App.
10 Termination of your account
You may delete your account at any time. We are currently working on adding a function to make it possible to delete the account in the App. Until we have this in place, you must contact us wither via chat or by e-mail, to have your account deleted. See section 12 for our contact information.
If you want to cancel a purchased subscription, please see section 4.
11 Governing Law and Jurisdiction
This Agreement will be governed by Norwegian Law.
If a dispute arises between you and DrivstoffAppen AS, we will first try to resolve the dispute amicably through an agreement between the parties. If this is not possible the dispute can be brought to the relevant consumer council depending on whether you are a Swedish, Finnish or a Danish citizen.

If the case remains unsettled, it shall be resolved by the courts of Norway, hereunder Buskerud District Court.
